Consumer Ombudsman sues Finnair over flight delay compensation practices

Legal action is being taken against Finnish airline Fainnair over the airline's policy of denying flight compensation claims caused by some technical faults.

The case is being taken to the Market Court by Finland’s consumer Ombudsman, who is asking the court for three injunctions and requesting a 500,000 euro fine be applied to each of them.

European law governing flight claims is laid out in EU directive 261/2004.

It states that passengers should receive between 250 and 600 Euros in compensation for delays that are over three hours and deemed to be the fault of the airline. The distance covered by their flight is also a factor.

The Ombudsman is claiming that rather than paying the appropriate amounts of compensation in cash, they are instead offering passengers vouchers or a lesser amount in cash.

Passengers are also being told that if they accept the compensation offered, they must waive all rights to further compensation.
